  • Huge MBS Lawsuits ()  A Jan. 25 decision by the U.S. Bankruptcy Court in New York could "have profound effects on assumptions relating to the subordination of swap termination payments to a swap counterparty following a swap counterparty bankruptcy," Moody's Investors Service warned. The decision was tied to the Dante collateralized-debt obligation in the Lehman Brothers bankruptcy proceedings. In King County Superior Court, Wash., the Federal Home Loan Bank of Seattle filed almost a dozen lawsuits last month against companies that were tied to the issuance of mortgage-backed securities the FHLB invested in.
  • BoA Target of 2 Investor Lawsuits ()  New York's attorney general filed a lawsuit in against Bank of America Corp. and its one of its current and former senior executives, a new release said. The state claims the defendants deceived shareholders by failing to disclose $16 billion in losses at Merrill Lynch prior to its late 2008 acquisition of the investment banker. BoA is also facing a class action filed on behalf of investors of its securities, Finkelstein & Krinsk LLP said in a news release.
  • 2009's Biggest Reverse Mortgage Lenders ()  Total reverse mortgage production from all U.S. lenders was 111,864 units during 2009, Reverse Market Insight reported. Wells Fargo Bank, N.A., closed more reverse mortgages than any other lender, according to the report. Bank of America, N.A., was next.
